MADR working session

• The meeting, convened by ROMPAN, focused on discussions regarding Law 96/2023.

Yesterday, on 06.12.2023, a working meeting took place at the headquarters of the Ministry of Agriculture and Rural Development (MARD) to clarify aspects related to the application of the provisions of Law 96/2023 regarding the tax on food products with added sugar. The meeting, convened at the request of Rompan, was chaired by Minister Florin Ionuț Barbu.

The Romanian Employers' Association of the Milling, Bakery and Flour Industry, together with other representatives of the food industry, presented to Minister Barbu the problems that this industry is currently facing.

It was emphasized that recently numerous requests were sent to the ministry to clarify the articles of various adopted normative acts, in order to ensure a correct and uniform application of these provisions by the operators.

Two important aspects emerged from the discussions:

breaker requested clarifications regarding the detailing of product groups "cakes" and "biscuits", code CAEN 1072 – Manufacture of biscuits and biscuits; manufacture of cakes and preserved pastry products.

This category includes the manufacture of biscuits, biscuits and other products "dry" bakery, the production of pastries and preserved cakes, as well as the manufacture of snack products (homemade cakes, biscuits, pretzels, etc.), sweet or savory.

For biscuits, from a technological point of view, the category covers any type of biscuit: with gluten, with sugar, plain or with filling, glazed and unglazed, eugenia, biscuits, cookies, regardless of the weight, and falls within the provisions of CAEN code 1072.

The second point of the discussions concerned the clarification of the phrase "total sugar content is at least 10 9/100 g product" . According to Rompan's proposal, it will be clarified that this category includes products that have a total added sugar content during manufacturing of 10 g/100 g finished product, as can be verified from the manufacturing recipe.

The requests made by Rompan were understood by Mr. Barbu, who is to establish together with ANAF the way to clarify these aspects in the shortest possible time, so that the legislation can be applied correctly starting from January 1, 2024 .
