ROMPAN reminds all members that,,REGULATION (EU) 20191649 OF THE COMMISSION of April 24, 2019 amending Annex III to Regulation (EC) no. 192512006 of the European Parliament and of the Council regarding trans fatty acids, other than trans fatty acids naturally found in fats of animal origin, entered into force as early as 2019. According to the provisions of this regulation, Article 4 states that Food products that do not comply with this regulation may continue to be placed on the market until 1 April 2021. We recommend that you ensure that you fully comply with the provisions of this regulation on 1 April 2021". Non-compliant food products will no longer be able to be placed on the market
Non-compliant food products will no longer be able to be placed on the market after April 1, 2021. This is also provided for by the law adopted last year and the European directive in this regard. Practically, from April 1, 2021, the rules regarding trans-unsaturated fatty acids in food composition are changing. Their quantity in the finished product must be a maximum of 2 grams per hundred grams of product.
The law initiated three years ago, and promulgated last year in August, shows that the category of foods in which trans acids were present in a proportion of 40-50% includes products such as microwave popcorn, spreads, biscuits, prepackaged cakes, margarine , thermally prepared products for frying, soups in envelopes, sauces, prepackaged cereals, wafers or chips. The new rules apply to all food products intended for the final consumer, including those from third countries and other EU member states.
Fines between 10.000 and 30.000 lei
Excluded from the scope of the new law are food products that naturally contain trans fatty acids in animal fats, such as meat or dairy products from cow, sheep or goat milk where fatty acids represent between 0,3% and 0,8 .XNUMX% of the total daily energy intake.
Producers who will not comply with the law risk fines between 10.000 and 30.000 lei. And the products will be withdrawn from the market.
